The Supreme Court has now held that a Court should give effect to pre-nuptial agreements that were freely entered into unless exceptional circumstances mean it would now be unfair to hold them to their agreement.

A properly drafted ‘pre-nup’ setting out the basis for the division of assets on marriage breakdown will be implemented, saving couples who take the precaution of making a pre-nuptual agreement both money and acrimony should they separate.
